男子買“60歲后按月領取50萬元”保險，繳費30年后僅領一個月便遭拒，保險公司：“一次性領取”誤寫成“按月領取”

據第一現場報道，近日，廣東深圳的陳先生向記者爆料稱，自己繳的養老保險，在到期兌現時卻遭保險公司拒付。

A Shenzhen resident has filed a lawsuit against an insurance company that refused to pay his pension benefits as stated in a policy he had maintained for 30 years, after the insurer claimed the contract terms were the result of a clerical error.

據了解，1995年，陳先生花費4055元（經換算相當于現在的43000元）購買了一份養老保險，堅持繳費30年。可當他年滿60歲滿心歡喜等待兌現時，卻遭遇了“羅生門”：保單上白紙黑字明確寫著“60歲后按月領取50萬”，但他僅收到首月款項后，保險公司便拒絕繼續支付。

The policyholder, surnamed Chen, purchased an endowment insurance policy in 1995 for 4,055 yuan, equivalent to roughly 43,000 yuan in today's purchasing power. He made premium payments consistently for three decades. When he turned 60 and went to collect his benefits, the policy clearly stated: "Receive 500,000 yuan monthly after age 60." However, after receiving only the first monthly payment, the insurance company stopped all further disbursements.

面對質疑，保險公司回應稱，當年因設備不完善，員工錄入疏忽將“一次性領取”誤寫成了“按月領取”，屬于操作失誤，而且當年經手的員工已經“不知所蹤”。

The insurer later explained that the discrepancy arose from an entry error made by an employee decades ago, when record?keeping equipment was less advanced. According to the company, the employee mistakenly typed "monthly payment" instead of "lump?sum payment", and that staff member has since left the firm and cannot be traced.

然而，陳先生及其代理律師對此并不買賬。律師指出，保單上沒有任何容易引起異議的詞語，保險公司理應給出合理解釋。更關鍵的是，即便保單存在錯誤，依據相關規定，保險公司行使糾正權或撤銷權的期限最長為5年。該保單1995年投保，糾正期最遲在2000年就已滅失。

Chen and his legal counsel rejected that explanation. His lawyer pointed out that the policy wording contains no ambiguous language that could reasonably be misinterpreted, and that the insurer should therefore honour the contract. The lawyer also argued that even if the policy contained an error, relevant regulations give the insurer a maximum of five years to exercise its right to correct or rescind the contract. Since the policy was issued in 1995, that correction window would have expired by 2000 at the latest.

這起跨越30年的保單糾紛，不僅關乎普通人的養老錢，更是對契約精神的考驗。目前，陳先生委托律師向法院提起了訴訟，該案件將于7月13日在深圳市寶安區人民法院開庭審理。

Chen has now turned to the courts, and his lawsuit is scheduled for trial in mid?July.
